1. Acceptance of terms
These Terms of Service ("Terms") govern your access to and use of the HerKitchen website and mobile applications on iOS and Android (together, the "Services"), operated by Kairoo Technologies Pvt Ltd ("HerKitchen", "we", "us", "our"). By creating an account or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.
2. Eligibility & accounts
- You must be at least 18 years old and capable of entering into a binding contract under Indian law to use the Services.
- You are responsible for maintaining the confidentiality of your account credentials and OTP, and for all activity under your account.
- You must provide accurate, current, and complete information when registering, and keep it updated.
- HerKitchen is currently available only in select service areas (Pune, Mumbai, and Bangalore) and may expand or restrict coverage at its discretion.
3. Description of service
HerKitchen is a subscription-first marketplace that connects customers with independent, verified home cooks for tiffin and meal subscriptions. HerKitchen facilitates discovery, ordering, payment, and delivery logistics, but the home cooks listed on the platform are independent third parties responsible for preparing the food. HerKitchen is not itself a restaurant or food manufacturer.
4. Subscriptions, orders & payments
- Prices for plans and individual meals are displayed in the app at the time of order and may vary by cook, location, and plan.
- Weekly and monthly subscriptions are billed in advance and, where auto-renewal is enabled, will automatically renew at the end of each billing cycle unless cancelled before renewal.
- Payments are processed through third-party payment gateways. HerKitchen does not store your full card or bank details.
- Wallet credits, where issued (e.g. for cancellations or refunds), can be used toward future orders and are non-transferable and non-redeemable for cash except as required by law.
- We take reasonable steps to prevent duplicate charges; if you believe you have been charged in error, contact us within 7 days of the charge.
5. Cancellations, pauses & skips
Full cancellation, pause, and skip terms, along with applicable refund timelines, are set out in our Refund Policy, which forms part of these Terms. In general:
- You may skip or pause individual delivery days from the app, subject to the cook's cut-off time for that day (typically shown in-app).
- Cancelling a subscription stops future billing; unused prepaid meals may be eligible for a wallet credit or refund as described in the Refund Policy.
- HerKitchen or a cook may cancel an order due to unavailability, kitchen closure, or force majeure events, in which case affected amounts will be refunded or credited.
6. Home cooks & kitchens
- Home cooks must hold a valid FSSAI registration and pass HerKitchen's kitchen verification process before being listed.
- Home cooks are independent operators, not employees or agents of HerKitchen, and are solely responsible for the quality, safety, and hygiene of the food they prepare.
- HerKitchen may suspend or remove a cook's listing for failing safety checks, repeated customer complaints, or violation of these Terms.
- Cooks agree to HerKitchen's separate cook/partner terms covering payouts, commissions, and conduct, where applicable.
7. User conduct
You agree not to:
- Use the Services for any unlawful purpose or in violation of these Terms.
- Harass, threaten, or abuse cooks, delivery partners, or HerKitchen staff.
- Submit false information, fraudulent payment methods, or fraudulent refund/cancellation claims.
- Attempt to reverse-engineer, scrape, or interfere with the Services' normal operation or security.
- Circumvent the platform to transact directly with a cook or delivery partner in a way that avoids applicable fees.
8. Reviews & ratings
Only customers who have received a delivered order may rate and review that cook. Reviews must be honest, based on genuine experience, and must not contain abusive, defamatory, or unlawful content. HerKitchen may remove reviews that violate this policy.
9. Intellectual property
The HerKitchen name, logo, app, website, and all related content (excluding user-submitted content and cook-owned photos) are the property of Kairoo Technologies Pvt Ltd and are protected by applicable intellectual property laws. You may not copy, modify, or distribute any part of the Services without our prior written consent.
10. Disclaimers
The Services are provided on an "as is" and "as available" basis. While we verify FSSAI registration and conduct kitchen inspections, HerKitchen does not guarantee that every meal will be free of allergens or suitable for every dietary requirement — please review dish descriptions and communicate allergies before ordering. We do not guarantee uninterrupted or error-free operation of the Services.
11. Limitation of liability
To the maximum extent permitted by law, HerKitchen and Kairoo Technologies Pvt Ltd shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Services, including issues with food quality prepared by independent home cooks, delays in delivery, or loss of data. Our total liability for any claim arising from the Services shall not exceed the amount you paid to HerKitchen in the three months preceding the claim.
12. Suspension & termination
We may suspend or terminate your access to the Services at any time, with or without notice, if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or posed a risk to other users, cooks, or the platform. You may stop using the Services and delete your account at any time from the app.
13. Governing law & disputes
These Terms are governed by the laws of India. Any disputes arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts located in Pune, Maharashtra, India, except where mandatory consumer protection law provides otherwise.
14. Changes to these terms
We may update these Terms from time to time to reflect changes in our Services or legal requirements. We will update the "Effective date" above and, for material changes, notify you via the app or email. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
